Powertarps Product Warranty

1. General

(a) This is a limited warranty (Warranty) offered by Powertarps Pty Ltd ACN 105 269 510 (Powertarps, we, us or our).

 

(b) The benefits provided to you under this Warranty are in addition to other rights and remedies available to consumers under the Australian Consumer Law.

 

(c) Where applicable, this is the Warranty referred to in the terms applicable to your purchase from Powertarps (Terms).

 

(d) When placing an order for a Product, please provide the registration number of the truck as your reference number for easy access to Warranty information.

 

2. Warranty offered by Powertarps

(a) Powertarps warrants that any Product -

         

                               (i) manufactured by us and sold to you by us;

 

                               (ii) manufactured by us and sold to you by an authorised third-party seller (Authorised

                               Reseller); and

 

                               (iii) not otherwise excluded from the Warranty under any other section of this document;

                               will be free from defects in materials and workmanship for a Warranty Period of 12 months.

 

(b) Powertarps warrants that any Installation of Products -

 

                               (i) manufactured by us and installed for you by us;

 

                               (ii) manufactured by a third party and installed for you by us; and

                               (iii) not otherwise excluded from the Warranty under any other section of this document;

                               will be free from defects in workmanship for a Warranty Period of 12 months.

 

(c) For any product manufactured by a third party and sold to you by us, we will provide reasonable

assistance in relation to any valid claim you have under the manufacturer’s warranty.

 

(d) The Warranty Period starts from the date of original purchase of the Product from Powertarps

or an Authorised Reseller.

 

(e) The Warranty is transferrable with the vehicle the Product was originally fitted to.

 

3. What is excluded from the Warranty?

The Warranty does not apply to any Product that is or has been:

(a) purchased at a discount with noted defects;

(b) subject to inspections, alterations, modifications, reinstallation, tampering, attempted repair or any other interventions made by a third party and without Powertarps’ consent;

(c) damaged due to circumstances outside of Powertarps’ control (for example, damage due to being mishandled by you or someone else, being involved in a motor vehicle accident, or resulting from natural causes);

(d) removed from the original vehicle that the Product was fitted to;

 

(e) fitted incorrectly including as a result of:

                                   (i) a failure by you to follow our instructions or guidelines;

 

                                   (ii) a failure by an Authorised Reseller to provide accurate instructions or guidelines;

 

                                   (iii) a failure by an Authorised Installer to follow our instructions or guidelines; or

 

                                   (iv) the Product being installed by someone other than an Authorised Installer;

 

(f) retrofitted with non-genuine Powertarps parts or modified Powertarps parts;

 

(g) used in way that is inconsistent with any manuals, user guides or any other similar documents or information regarding proper use of the Product provided by us, an Authorised Reseller or an Authorised Installer to you; and

 

(h) subject to fair wear and tear or anything otherwise resulting from normal aging.

4. How do I make a claim?

(a) If you believe a Product is defective and covered by the Warranty, you must follow the process

below to claim under the Warranty:

 

                             (i) First call Powertarps on 1300 182 777 to lodge the claim.

                             (ii) If the issue cannot be fixed on site, you will then need to contact reception@powertarps.com.au with the                                              following details;

 

                                                              (A) The invoice number

 

                                                              (B) Product name

 

                                                              (C) Serial number (including tarps)

 

                                                              (D) Description of the product issue

 

(b) We will not be able to assess your Warranty claim without the above information.

 

(c) We may request that you provide additional information, including photos, in order to assess your claim. We will not be able to assess your claim if you do not provide us with this information.

 

5. What happens after I make a claim?

(a) We will liaise with you as soon as reasonably practicable after receiving your claim.

 

(b) There may be circumstances in which we are unable to determine whether your Warranty claim is valid without the Product being returned to us. In these circumstances:

 

                            (A) we will provide you with instructions on how to return the Product to us for assessment;

 

                            (B) you must package the Product and notify us of the dimensions of that package;

 

                            (C) Powertarps will arrange and pay for collection and shipping of the Product; and

 

                            (D) you must ensure the packaged Product is available for collection at the time required as notified by us to you.

 

(c) Once we receive the Product, we will conduct testing on the Product to assess (in our discretion) whether or not your Warranty claim is valid.

6. What are our obligations if you make a valid claim?

(a) If we determine that your Warranty claim is valid, we will notify you of the remedy we can provide under the Warranty, which will be either a replacement or repair.

                             (i) For a replacement:

 

                                                              (A) we will arrange for a replacement item to be sent to your nominated Australian

                                                              address; and

 

                                                              (B) the returned Product will become property of Powertarps upon receipt by you of the                                                                 replacement item.

 

                              (ii) For a repair:

 

                                                              (A) we will notify you of the time required to repair the Product; and

 

                                                              (B) once repaired, the Product will be sent back to you to your nominated Australian

                                                              address with the original document and a receipt of repair.

 

(b) If we determine that your Warranty claim is not valid, we will notify you of the reasons why and:

 

                            (i) you will be responsible for our reasonable costs in assessing your claim; and

 

                            (ii) you may still elect to proceed with repair or replacement whereby, subject to any other

                            rights you may have under Australian Consumer Law, you will be responsible for the

                            costs of repair or replacement being undertaken by Powertarps.

7. Australian Consumer Law

Notwithstanding this Warranty, our Products come with guarantees that cannot be excluded under the

Australian Consumer Law, which include (among other things) an entitlement to:

(a) replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage; and

(b) repair or replacement for goods that fail to be of acceptable quality but where the failure does not amount to a major failure.

8. Limitation of liability

(a) Subject to paragraph 7, this Warranty does not affect or override any limitations on Powertarps’ liability that you have agreed with us as set out in the Terms.

(b) For the avoidance of doubt, to the maximum extent permitted by law, we are not liable for consequential loss resulting from any breach of this Warranty, including but not limited to loss of revenue, loss of actual or anticipated profits, loss of business, loss of opportunity, loss of goodwill or loss of reputation.

 

9. Amendments to this Warranty

Powertarps may make changes to this document from time to time for future purchases of the Products. This version of the document is applicable as at the date that the Warranty Period starts for your purchased Products.
